1. Agreement to Terms
By accessing or using NeighborhoodMail.com ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and NeighborhoodMail.com ("we," "our," or "us").
2. Description of Service
NeighborhoodMail.com is a group-buy direct mail platform that enables local businesses to purchase advertising slots on shared 9x12 glossy postcards delivered via USPS Every Door Direct Mail (EDDM) to residential addresses in targeted neighborhoods. Each campaign accommodates up to 8 advertising slots with category exclusivity.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
You may register using your email address or through a third-party authentication provider such as Google. By using third-party authentication, you authorize us to access certain account information from that provider as described in our Privacy Policy.
4. Slot Purchases and Payments
Pricing
The price per advertising slot is displayed on each campaign page. Currently, the standard price is $500 per slot. Prices are subject to change for future campaigns.
Payment Processing
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your credit card information on our servers.
Campaign Fulfillment Model
Campaigns only proceed to print when all available slots are filled. If a campaign does not reach full capacity, your payment authorization will be released and you will not be charged. Once a campaign is full and proceeds to production, payments are final.
Refunds
Because campaigns are produced and mailed as a group, refunds are generally not available once a campaign has been marked as full and sent to production. If you need to cancel before the campaign is full, contact us at hello@neighborhoodmail.com and we will work with you on a case-by-case basis.
5. Category Exclusivity
Each campaign offers category exclusivity, meaning only one business per category (e.g., one plumber, one pizza shop) may appear on a given campaign mailer. We reserve the right to determine category classifications and resolve any disputes regarding category assignments at our sole discretion.
6. Ad Artwork and Content
Submission Requirements
You are responsible for providing print-ready ad artwork that meets our specifications. Artwork must be submitted in PDF, PNG, or JPG format at print resolution.
Content Standards
You represent and warrant that your advertising content:
- Is truthful and not misleading
- Does not infringe on any third party's intellectual property rights
- Complies with all applicable local, state, and federal laws and regulations
- Does not contain offensive, defamatory, or inappropriate material
- Accurately represents your business and the products or services offered
Artwork Approval
We reserve the right to review and approve or reject any submitted artwork at our sole discretion. If artwork is rejected, we will notify you and provide an opportunity to submit revised artwork before the campaign goes to print.
7. Digital Mailer Pages
After a campaign is mailed, we may create a public digital version of the mailer that displays participating business information including business name, category, tagline, website URL, and phone number. By participating in a campaign, you consent to this public display of your business information.
Digital mailer pages may include click and engagement tracking to measure campaign performance.
8. USPS EDDM Delivery
We use USPS Every Door Direct Mail for campaign delivery. While we make every effort to ensure timely delivery, we are not responsible for delays, non-delivery, or damage caused by USPS. Delivery timelines are estimates and not guarantees. EDDM delivery typically covers all residential addresses on selected postal routes.
9. Intellectual Property
The NeighborhoodMail.com name, logo, website design, and original content are our intellectual property and are protected by copyright and trademark laws. You may not copy, modify, or distribute our intellectual property without written consent.
You retain ownership of your submitted ad artwork. By uploading artwork to our platform, you grant us a non-exclusive, royalty-free license to use, reproduce, and display your artwork for the purpose of producing and distributing the mailer campaign and associated digital mailer pages.
10. Limitation of Liability
To the maximum extent permitted by law, NeighborhoodMail.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless NeighborhoodMail.com, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your ad content, or your violation of these Terms.
12. Termination
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any modifications constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which NeighborhoodMail.com operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
